Company terms you should review before booking.
Article 1 (Application of Terms and Conditions)
The Company shall rent vehicles (hereinafter referred to as "rental cars") to the renter in accordance with these Terms and Conditions and the detailed regulations based on Article 40 (hereinafter collectively referred to as "the Terms"). The renter shall borrow the rental car upon understanding and agreeing to the Terms. If the renter designates a driver other than the renter under Article 8, Paragraph 3, the renter shall inform such driver of the relevant provisions of the Terms and ensure compliance. Matters not stipulated in the Terms shall be governed by laws, regulations, or general customs.
The Company may agree to special provisions within the scope not contrary to the spirit of these Terms, detailed regulations, laws, administrative guidance, and general customs. In such cases, the special provisions shall prevail over these Terms.
Article 2 (Application for Reservation)
The renter, when renting a rental car, may apply for a reservation by agreeing to these Terms, the separately defined fee schedule, and other relevant provisions, and by specifying in advance the vehicle class, rental start date and time, rental location, rental period, return location, driver, whether a child seat or other accessories are required, and other rental conditions (hereinafter referred to as "rental conditions") by methods separately defined.
When an application for reservation is received from the renter, except in cases where proxy rental is conducted in accordance with Article 34, Paragraph 1 (including cases where a vehicle subject to proxy rental is provided as a substitute vehicle), the Company shall, in principle, accept reservations within the scope of the rental cars it possesses. In this case, unless specifically exempted by the Company, the renter shall pay the reservation deposit as separately defined.
Article 3 (Change of Reservation)
If the renter intends to change the rental conditions under Paragraph 1 of the preceding Article, the renter must obtain prior approval from the Company.
Article 4 (Cancellation of Reservation, etc.)
The renter may cancel the reservation by methods separately defined.
If, for reasons attributable to the renter, more than one hour has passed since the reserved rental start time and the rental agreement (hereinafter referred to as "the Rental Agreement") procedures have not begun, the reservation shall be deemed canceled.
In the cases of the preceding two paragraphs, the renter shall pay the reservation cancellation fee as separately defined, and upon payment of said cancellation fee, the Company shall refund the reservation deposit received.
If the reservation is canceled or the Rental Agreement is not concluded for reasons attributable to the Company, the Company shall refund the reservation deposit received and pay compensation as separately defined.
If the Rental Agreement cannot be concluded due to accidents, theft, non-return, recall, natural disasters, or other causes not attributable to either the renter or the Company, the reservation shall be deemed canceled. In this case, the Company shall refund the reservation deposit received.
Article 5 (Substitute Rental Car)
If the Company cannot provide the rental car of the vehicle class reserved by the renter, it may propose the provision of a different vehicle class rental car (hereinafter referred to as "substitute rental car").
If the renter accepts the proposal of the preceding paragraph, the Company shall provide the substitute rental car under the same rental conditions as at the time of reservation, except for the vehicle class. If the rental fee for the substitute rental car exceeds that of the reserved vehicle class, the rental fee for the reserved class shall apply. If it is lower, the rental fee for the substitute rental car’s class shall apply.
The renter may refuse the proposal of a substitute rental car under Paragraph 1 and cancel the reservation.
In the case of cancellation under the preceding paragraph, if the cause of the inability to provide the reserved vehicle class rental car is attributable to the Company, it shall be treated as a cancellation under Article 4, Paragraph 4, and the Company shall refund the reservation deposit received and pay compensation as separately defined.
In the case of cancellation under Paragraph 3, if the cause of the inability to provide the reserved vehicle class rental car is not attributable to the Company, it shall be treated as a cancellation under Article 4, Paragraph 5, and the Company shall refund the reservation deposit received.

Article 8 (Conclusion of Rental Agreement)
The renter shall specify the rental conditions prescribed in Article 2, Paragraph 1, and the Company shall specify the rental conditions in accordance with these Terms and the fee schedule, and the Rental Agreement shall be concluded. Upon conclusion of the Rental Agreement, the renter shall pay the rental fee specified in Article 11, Paragraph 1, to the Company.
Based on the Ministry of Land, Infrastructure, Transport and Tourism (MLIT) guidelines (Note 1), the Company shall record the driver’s name, address, driver’s license category, and license number on the rental ledger and the rental certificate prescribed in Article 14, Paragraph 1, or attach a copy of the driver’s license. For this purpose, at the time of concluding the Rental Agreement, the Company may request the renter to present the designated driver’s driver’s license (or a copy thereof). If the renter himself/herself is the driver, the renter shall present his/her own driver’s license or a copy thereof. If the renter and the driver are different, the designated driver must present his/her license or a copy thereof.

Acts of violence, abusive language, or unreasonable demands beyond acceptable limits toward the Company or its employees.
Defamation, fraud, or obstruction of business damaging the Company’s credibility.

If a reservation had already been made in such cases, it shall be treated as canceled, and upon payment of the cancellation fee, the Company shall refund the reservation deposit received.
Article 10 (Establishment of Rental Agreement)
The Rental Agreement shall be established when the renter pays the rental fee to the Company and the Company delivers the rental car to the renter. In such case, the reservation deposit already paid shall be applied toward the rental fee.
The delivery under the preceding paragraph shall take place at the rental location specified in Article 2, Paragraph 1, at the start time specified therein.

If rental fees are revised after reservation, the lower of the reservation rate or the rate at the time of rental shall apply.
Detailed provisions regarding rental fees shall be set forth in the Company’s detailed regulations.
Article 12 (Change of Rental Conditions)
If the renter wishes to change the rental conditions after concluding the Rental Agreement, the renter must obtain prior approval from the Company.
The Company may refuse approval if the requested changes interfere with its rental operations.
Article 13 (Inspection and Confirmation)
The Company shall conduct periodic inspections and necessary maintenance under Article 48 of the Road Transport Vehicle Act, and deliver a fully charged rental car.
The Company shall also conduct daily inspections and necessary maintenance under Article 47-2 of the Road Transport Vehicle Act, including for rental cars received via proxy rental under Article 36.
The renter or driver shall confirm, based on the inspection sheet, that no defects exist in the rental car’s condition and that it meets the rental conditions.
If defects are found during the above confirmation, the Company shall immediately perform the necessary maintenance.
Article 14 (Rental Certificate: Issuance, Carrying, etc.)
When delivering the rental car, the Company shall issue to the renter a rental certificate (in paper or electronic form) recording the required items prescribed by the Regional Transport Bureau Director.
The renter or driver must carry this rental certificate (including electronic form) while using the rental car.
If the certificate is lost, the renter or driver must immediately notify the Company.
Article 15 (Management Responsibility, etc.)
From the time of delivery until return, the renter or driver shall use and keep the rental car with the duty of care of a prudent manager.
If the renter or driver uses toll roads, paid parking, or other paid services, they shall bear such costs directly.
If the Company receives a request from a service provider (based on the rental car’s license plate and date) for disclosure of the renter’s personal information due to non-payment, the renter agrees that the Company may provide such personal information.

The renter or driver shall return the rental car to the Company at the designated return location by the expiration of the rental period.
If the renter or driver violates the preceding paragraph, the renter shall compensate the Company for damages caused thereby.
If the renter or driver is unable to return the rental car within the rental period due to force majeure such as natural disasters, neither the renter nor the driver shall be held liable for damages incurred by the Company. In such case, the renter or driver shall immediately contact the Company and follow its instructions.
Article 22 (Confirmation upon Return, etc.)
The renter or driver shall return the rental car in the presence of the Company. In this case, the car shall be returned in the same condition as at the time of delivery, except for ordinary wear and tear from normal use.
Upon return of the rental car, the renter or driver shall confirm that no personal belongings of the renter, driver, or passengers remain inside the vehicle.

If the renter or driver fails to return the rental car to the designated return location upon expiration of the rental period and does not comply with the Company’s request for return, or if the renter’s whereabouts become unknown and the car is deemed non-returned, the Company may take legal action such as filing a criminal complaint, report the non-return incident to the All Japan Rent-a-Car Association, and register the information with the Nationwide Rent-a-Car Association System.
In such cases, the Company may take necessary measures to confirm the vehicle’s location, including inquiries with the renter’s or driver’s family, relatives, workplace, and activation of GPS functions.
In such cases, the renter shall be liable for damages caused to the Company, as well as for costs incurred in retrieving the rental car and locating the renter or driver.

If the renter does not accept a replacement, or if the Company cannot provide one, the Company shall fully refund the rental fee already received.
If the malfunction, etc. is due to neither the renter’s, driver’s, nor the Company’s fault, the Company shall refund to the renter the portion of the rental fee corresponding to the unused period, deducting the fee for the period from rental until termination.
The renter shall not make any claims against the Company for damages arising from inability to use the rental car, except as provided herein, unless the malfunction, etc. was caused by the Company’s intent or gross negligence.

However, damages to rental cars lost or damaged due to a disaster officially designated as a “severe disaster” under the Act on Special Financial Support for Severe Disasters shall not require compensation, unless caused by intent or gross negligence.
