(Application of Terms and Conditions)
Article 1
The lessor (hereinafter referred to as “the Company”) shall rent a motor vehicle (hereinafter referred to as “rental car”) to the lessee in accordance with the provisions of this Rental Agreement (hereinafter referred to as “Agreement”), and the lessee shall rent the vehicle from the Company.
If the lessee designates a driver who is different from the lessee, as stated in Article 8, Paragraph 3, the lessee shall ensure that the driver is made aware of and complies with the relevant parts of this Agreement.
Matters not stipulated in this Agreement shall be governed by the Detailed Regulations in Article 38 (hereinafter referred to as “Detailed Rules”), applicable laws, and general customs.
The Company may agree to special terms within the scope that does not conflict with the purpose of this Agreement, the Detailed Rules, laws, administrative notices, and general customs. In such cases, the special terms shall take precedence over this Agreement.
(Reservation Application)
Article 2
When reserving a rental car, the lessee may apply for a reservation by specifying the vehicle class, rental start date and time, pickup location, rental period, return location, driver, need for optional items such as child seats, and other rental conditions (hereinafter referred to as “Rental Conditions”) via the method prescribed by the Company, after agreeing to this Agreement, the Detailed Rules, and the separately defined Fee Table.
Upon receiving a reservation application, the Company will, in principle, accept the reservation within the range of available rental cars. In this case, the lessee shall pay a separately designated reservation deposit.
(Changes to Reservations)
Article 3
If the lessee wishes to change the Rental Conditions stated in Paragraph 1 of the previous article, the lessee must obtain prior approval from the Company.
(Cancellation of Reservations, etc.)
Article 4
The lessee may cancel a reservation using the method prescribed by the Company.
2. If the lessee does not begin the contract process for the rental car more than one hour after the reserved start time due to personal reasons, the reservation shall be deemed canceled.
3. In the cases above, the lessee shall pay a cancellation fee as separately specified. Upon receiving the cancellation fee, the Company shall refund the reservation deposit already received.
4. If the reservation is canceled or the rental contract is not concluded due to reasons attributable to the Company, the Company shall refund the reservation deposit already received and pay a penalty as separately specified.
5. If the rental contract cannot be concluded due to accidents, theft, failure to return, recalls, natural disasters, or other reasons not attributable to either the lessee or the Company, the reservation shall be deemed canceled. In this case, the Company shall refund the reservation deposit already received.
(Substitute Rental Car)
Article 5
If the Company is unable to provide a rental car of the class reserved by the lessee, the Company may offer a substitute rental car of a different class (hereinafter referred to as “Substitute Vehicle”).
2. If the lessee accepts the offer in the previous paragraph, the Company shall provide the Substitute Vehicle under the same Rental Conditions as the original reservation, excluding the vehicle class. If the rental fee of the Substitute Vehicle is higher than the reserved class, the fee for the reserved class shall apply. If it is lower, the fee for the Substitute Vehicle class shall apply.
3. The lessee may refuse the offer of the Substitute Vehicle and cancel the reservation.
4. In the above case, if the inability to provide the originally reserved vehicle is due to reasons attributable to the Company, it shall be treated as a cancellation under Article 4, Paragraph 4. The Company shall refund the reservation deposit and pay a penalty as separately specified.
5. If the cause of the situation in Paragraph 3 is not attributable to the Company, it shall be treated as a cancellation under Article 4, Paragraph 5. The Company shall refund the reservation deposit.
(Disclaimer)
Article 6
Except in cases defined under Articles 4 and 5, neither the Company nor the lessee shall make any claims against each other in the event that the reservation is canceled or the rental agreement is not concluded.

A rental agreement is concluded accordingly, except in cases where a rental car is not available, or the lessee or driver falls under any of the items listed in Article 9, Paragraphs 1 or 2.
Upon conclusion of the rental agreement, the lessee shall pay the rental fee specified in Article 11, Paragraph 1.
Based on the basic directive of the regulatory authority (Note 1), the Company shall record the name, address, type of driver's license, and license number of the driver on the rental agreement form and the rental certificate stipulated in Article 14, Paragraph 1, or attach a copy of the driver’s license. Therefore, when concluding the rental agreement, the Company may request the lessee to present and/or submit a copy of the driver's license of the designated driver. If the lessee is the driver, they shall present their own license or submit a copy. If the lessee and driver are different, the license or a copy must be presented/submitted for the driver.
Note 1: The basic directive refers to Directive No. 138 issued by the Director of the Automobile Transport Bureau, Ministry of Land, Infrastructure, Transport and Tourism on June 13, 1995, items 2.(10) and (11).

Spread rumors, used deception, or threats to harm the Company’s reputation or obstruct its operations.

Is otherwise deemed inappropriate by the Company.
In cases above where a reservation was already made, the reservation will be treated as canceled. If the lessee paid a cancellation fee, the Company shall refund the reservation deposit already received.
Article 10
The rental agreement is considered established when the lessee pays the rental fee and the Company hands over the rental vehicle. In this case, the reservation deposit shall be applied toward the total rental fee.

Article 11

The basic fee is based on the pricing filed with the Okinawa District Transport Bureau Office at the time of rental.
If the rental fee is revised after the reservation is made, the lower of the reservation-time price and the new price shall apply.
Article 12
If the lessee wishes to change the rental conditions specified in Article 8, Paragraph 1 after the contract is concluded, they must obtain prior approval from the Company.
The Company may decline such changes if they interfere with operations.

If defects are found during the confirmation process above, the Company shall promptly perform necessary maintenance.
Article 14
When handing over the rental vehicle, the Company shall issue a rental certificate to the lessee or driver, which includes required information as stipulated by the Okinawa District Transport Bureau.
The lessee or driver must carry this rental certificate while using the vehicle.
If the rental certificate is lost, the lessee or driver must notify the Company immediately.

If the Company is notified by the police of an unattended parking violation, the Company will instruct the lessee or driver to move or retrieve the vehicle and to report to the relevant police department by the end of the rental period or as directed. The lessee or driver must follow these instructions. The Company may, at its discretion, retrieve the vehicle from the police.
After giving instructions, the Company may verify whether the violation has been resolved using the traffic violation notice, payment slip, receipt, etc. If unresolved, the lessee or driver will continue to be instructed accordingly. The Company may also request the lessee or driver to sign a written acknowledgment (hereinafter “Acknowledgment Letter”) stating they recognize the violation and agree to follow legal procedures.
When deemed necessary, the Company may submit the Acknowledgment Letter, rental certificate, and other relevant documents (excluding personal ID numbers) to the police or Public Safety Commission in accordance with Article 51-4, Paragraph 6 of the Road Traffic Act, and take necessary legal action. The lessee and driver agree to cooperate.
If the Company receives a payment order for the unattended violation fine under Article 51-4, Paragraph 1 of the Road Traffic Act, or if the Company pays for any associated costs (e.g., tracking down the lessee/driver, towing, storage, etc.), the Company may charge the lessee for the following "Parking Violation-Related Fees":
The amount of the unattended violation fine
A penalty as separately defined by the Company
Costs related to tracking, towing, storage, and retrieval
If the lessee or driver fails to comply with the Company’s instruction or sign the Acknowledgment Letter, the Company may collect a fixed amount of “Parking Violation Fee,” as separately determined, to cover the unattended violation fine and penalties.

In such cases, the lessee shall bear the cost of vehicle retrieval and repair, and the Company will not refund the rental fee already paid. However, this does not apply to cases covered under Paragraphs 3 or 5.
If the malfunction is due to a defect that existed before rental or if the vehicle does not meet the rental conditions, the lessee may receive a replacement vehicle, and a new rental agreement will be made. Article 5, Paragraph 2 applies to the terms of the replacement vehicle.
If the lessee declines the replacement vehicle or if the Company cannot provide one, the rental fee already paid shall be fully refunded.
If the malfunction is due to reasons not attributable to the lessee, driver, or the Company, the Company will refund the portion of the rental fee corresponding to the unused rental period.
