Rental Car Agreement Terms and Conditions
Chapter 1: General Provisions
Article 1 (Application of Terms)
The Company shall rent a vehicle (hereinafter referred to as the "Rental Car") to the Renter in accordance with these Terms, and the Renter shall accept the rental.
Matters not specified in these Terms shall be governed by the Detailed Rules (Article 36), applicable laws and regulations, or general customs.
The Company may agree to special terms to the extent that they do not contradict the purpose of these Terms, the Detailed Rules, laws and regulations, administrative directives, or general customs. In the case of special terms, such terms shall take precedence over these Terms.
Chapter 2: Reservations
Article 2 (Reservation Application)
To rent a Rental Car, the Renter shall, after agreeing to these Terms and the separately specified price list, apply for a reservation in advance by clearly indicating the following rental conditions (hereinafter referred to as "Rental Conditions") through a specified method: vehicle class, rental start date and time, rental location, rental period, return location, driver, need for accessories such as child seats, and other rental conditions.
When the Company receives a reservation application from the Renter, it shall, in principle, honor the reservation within the scope of its available Rental Cars. In this case, the Renter shall pay a reservation deposit by a specified method, unless otherwise approved by the Company.
Article 3 (Modification of Reservations)
If the Renter wishes to modify the Rental Conditions specified in Article 2, Paragraph 1, prior approval from the Company is required.
Article 4 (Cancellation of Reservations, etc.)
The Renter may cancel a reservation by a specified method.
If the Renter fails to initiate the procedures for concluding the Rental Agreement (hereinafter referred to as the "Rental Agreement") within 1 hour of the scheduled rental start time due to the Renter’s circumstances, the reservation shall be deemed canceled.
In the cases specified in the preceding two paragraphs, the Renter shall pay a cancellation fee to the Company in accordance with separate provisions. Upon receipt of the cancellation fee, the Company shall refund any reservation deposit already received to the Renter.
If the reservation is canceled or the Rental Agreement is not concluded due to circumstances attributable to the Company, the Company shall refund any reservation deposit already received and pay damages in accordance with separate provisions.
If the Rental Agreement is not concluded due to reasons beyond the control of either the Renter or the Company (e.g., accident, theft, non-return, recall, natural disaster), the reservation shall be deemed canceled, and the Company shall refund any reservation deposit already received.
Article 5 (Alternative Rental Cars)
If the Company is unable to provide the reserved vehicle class, it may offer a Rental Car of a different class (hereinafter referred to as an "Alternative Rental Car").
If the Renter accepts the offer in the preceding paragraph, the Company shall provide the Alternative Rental Car under the same Rental Conditions as the reservation, except for the vehicle class. If the rental fee for the Alternative Rental Car is lower than that of the reserved class, the fee for the Alternative Rental Car shall apply.
The Renter may refuse the offer of an Alternative Rental Car in Paragraph 1 and cancel the reservation.
In the case of the preceding paragraph, if the inability to provide the reserved vehicle is due to reasons attributable to the Company, it shall be treated as a reservation cancellation under Article 4, Paragraph 5. The Company shall refund any reservation deposit already received and pay damages in accordance with separate provisions.
Article 6 (Exemption from Liability)
Except as provided in Articles 4 and 5, the Company and the Renter shall not make any claims against each other for the cancellation of a reservation or the failure to conclude a Rental Agreement.
Article 7 (Delegation of Reservation Services)
The Renter may apply for a reservation through travel agencies, partner companies, etc. (hereinafter referred to as "Agents") that handle reservation services on behalf of the Company.
A Renter who applies through an Agent may only request modifications or cancellations of the reservation through that Agent.
Chapter 3: Rental
Article 8 (Conclusion of Rental Agreement)
The Renter shall clearly specify the Rental Conditions in Article 2, Paragraph 1, and the Company shall clearly specify the rental conditions in these Terms and the price list to conclude the Rental Agreement, except when no Rental Car is available or when the Renter or driver falls under any of the items in Article 9, Paragraphs 1 or 2.
Upon concluding the Rental Agreement, the Renter shall pay the rental fee specified in Article 11, Paragraph 1 to the Company.

The Renter shall present their own license (if they are the driver) or the driver’s license (if different from the Renter) and provide a copy if requested.
(Note 1) The basic directive of the supervisory authority refers to Sections 2.(10) and (11) of the "Basic Directive on Rental Cars" issued by the Director of the Automobile Traffic Bureau, Ministry of Land, Infrastructure, Transport and Tourism (June 13, 1995).
(Note 2) "Driver’s license" refers to those specified in Article 92 of the Road Traffic Act, in the format prescribed in Appended Form 14 of the Road Traffic Act Enforcement Regulations. The Company shall request contact information (e.g., mobile phone number) for communication with the Renter and driver during the rental period when concluding the Rental Agreement.

After concluding the Rental Agreement, the Renter must obtain prior approval from the Company to modify the Rental Conditions in Article 8, Paragraph 1.
The Company may refuse such modifications if they would disrupt its rental operations.
Article 13 (Inspection and Confirmation)
The Company shall rent vehicles that have undergone inspections and necessary maintenance as specified in Article 48 of the Road Transport Vehicle Act (periodic inspections) and Article 47-2 (daily inspections).
The Renter or driver shall confirm that the inspections and maintenance in the preceding two paragraphs have been conducted, that the Rental Car is free from defects (based on a separate inspection checklist for exterior and accessories), and that it meets the Rental Conditions.
If defects are found during the confirmation in the preceding paragraph, the Company shall immediately perform necessary maintenance.
Article 14 (Issuance and Carrying of Rental Certificate)
Upon delivering the Rental Car, the Company shall issue a rental certificate (prescribed by the Director of the Regional Transport Bureau) to the Renter or driver, containing specified information.
The Renter or driver must carry the rental certificate while using the Rental Car.

If the Company is notified by the police of illegal parking, it shall instruct the Renter or driver to promptly move/retrieve the vehicle and report to the police station by the end of the rental period or a specified time; the Renter or driver shall comply. The Company may retrieve the vehicle from the police at its discretion.
After issuing the instruction in the preceding paragraph, the Company shall confirm the status of the violation (via traffic tickets, receipts, etc.) and reissue instructions if unresolved. It may also require the Renter or driver to sign a document acknowledging the violation and agreeing to legal procedures (hereinafter "Acknowledgment Form"), which the Renter or driver shall comply with.
If necessary, the Company may assist in pursuing the Renter’s/driver’s liability for illegal parking (e.g., submitting the Acknowledgment Form, rental certificate, and other personal information to the police) and take legal measures (e.g., submitting documents to the Public Safety Commission under Article 51-4, Paragraph 6 of the Road Traffic Act), to which the Renter or driver consents.
If the Company receives a parking violation notice and pays the fine, or bears costs for searching for the Renter/driver or retrieving/storing the vehicle, it may claim the following "parking violation-related costs" from the Renter or driver, who shall pay by a specified date:
(1) Amount equivalent to the parking violation fine

If the Renter or driver fails to comply with the Company’s instructions to resolve the violation or sign the Acknowledgment Form, the Company may collect a specified "parking violation fee" (to cover the amounts in the preceding paragraph).
If the Renter or driver pays the amount claimed under Paragraph 5 and the parking violation fine is later refunded to the Company (e.g., due to cancellation of the notice), the Company shall refund only the amount equivalent to the fine. The same applies if a parking violation fee was collected under Paragraph 6.
Chapter 5: Return
Article 19 (Duty to Return)

Article 20 (Confirmation Upon Return)

If the Breakdown, etc. is due to a pre-existing defect, a new Rental Agreement shall be deemed concluded, and the Renter may receive an Alternative Rental Car (subject to Article 5, Paragraph 2).
If the Renter refuses the Alternative Rental Car, the Company shall refund the full rental fee (same if
no Alternative Rental Car is available).
If the Breakdown, etc. is due to reasons beyond the control of the Renter, driver, or Company, the Company shall refund the rental fee minus the portion corresponding to the period from rental to termination.
