Dime Co., Ltd. (hereinafter referred to as the "Company") shall rent a registered automobile (hereinafter referred to as the "Rented Car") to the Renter in accordance with the provisions of these Terms and Conditions, and the Renter may rent the same. Any matters not provided for in these Terms and Conditions and its detailed regulations shall be governed by laws, regulations, or general customs.
The Company may enter into special agreements, provided that such agreements do not violate the purpose of these Terms and Conditions, detailed regulations, laws, regulations, or general customs. In the event that a special agreement is made, such special agreement shall take precedence over these Terms and Conditions and its detailed regulations.
When renting a Rented Car, the Renter may apply for a reservation after agreeing to these Terms and Conditions and the separately prescribed price list, by specifying in advance the vehicle class, date and time of rental commencement, rental location, rental period, return location, driver, necessity of accessories such as a child seat, and other rental conditions (hereinafter referred to as the "Rental Conditions") through methods separately prescribed.
Upon receipt of a reservation application from the Renter, the Company shall, in principle, accept the reservation within the scope of the Rented Cars in its possession. In this case, the Renter shall pay the separately prescribed reservation deposit to the Company, unless specifically permitted otherwise by the Company.
If the Renter intends to change any of the Rental Conditions specified in Paragraph 1 of the preceding Article, the Renter shall obtain the prior consent of the Company.
The Renter may cancel a reservation by methods separately prescribed.
If the Renter, due to their own circumstances, fails to commence the procedures for concluding a Rented Car Rental Contract (hereinafter referred to as the "Rental Contract") even after one (1) hour has elapsed from the reserved rental commencement time, the reservation shall be deemed canceled.
In the case of the preceding two paragraphs, the Renter shall pay a separately prescribed reservation cancellation fee to the Company. Upon receipt of this cancellation fee, the Company shall return the received reservation deposit to the Renter.
If a reservation is canceled or a Rental Contract is not concluded due to the circumstances of the Company, the Company shall return the received reservation deposit and pay a penalty fine equal to the amount of the reservation deposit.
If a Rental Contract cannot be concluded due to accidents, theft, non-return, recalls, natural disasters, or any other reasons not attributable to either the Renter or the Company, the reservation shall be canceled. In this case, the Company shall return the received reservation deposit.
If the Company cannot provide a Rented Car of the vehicle class reserved by the Renter, the Company may offer to rent a Rented Car of a different vehicle class (hereinafter referred to as the "Alternative Rented Car").
When the Renter accepts the offer mentioned in the preceding paragraph, the Company shall rent the Alternative Rented Car under the same Rental Conditions as those at the time of reservation, except for the vehicle class. If the rental fee for the Alternative Rented Car is higher than that of the reserved vehicle class, the rental fee for the reserved vehicle class shall apply. If it is lower, the rental fee for the vehicle class of the Alternative Rented Car shall apply.
The Renter may refuse the offer of the Alternative Rented Car mentioned in Paragraph 1 and cancel the reservation.

A Renter who has applied for a reservation through an Agent under the preceding paragraph may apply to change or cancel the reservation through that Agent.
The Rental Contract shall be concluded when the Renter specifies the Rental Conditions set forth in Article 2, Paragraph 1, and the Company specifies the rental terms via these Terms and Conditions, detailed regulations, price lists, important matters confirmation documents, etc.; provided, however, that this shall not apply when there is no Rented Car available to rent, or when the Renter or driver falls under any of the items of Article 9, Paragraph 1 or Paragraph 2.
Upon conclusion of the Rental Contract, the Renter shall pay the rental fee prescribed in Article 11, Paragraph 1 to the Company.

In this case, if the Renter is the Driver, the Renter shall present their own driver’s license (and submit a copy if requested); if the Renter and the Driver are different persons, the Driver’s license shall be presented (and a copy submitted if requested).

Upon conclusion of the Rental Contract, the Company shall require the notification of a contact telephone number (workplace, home, mobile phone number, etc.) to communicate with the Renter and the Driver during the rental period, and the Renter and the Driver shall comply with this request.
Upon conclusion of the Rental Contract, the Company may require payment by credit card or cash, or specify other payment methods.

The individual fails to meet other explicitly stated conditions.
In the cases described in the preceding two paragraphs, if a reservation had already been established with the Renter, it shall be treated as a cancellation of the reservation. If a reservation cancellation fee has been paid, the received reservation deposit shall be returned to the Renter.
The Rental Contract shall be established when the Renter pays the rental fee to the Company and the Company delivers the Rented Car to the Renter. In this case, the received reservation deposit shall be applied toward a portion of the rental fee.
The delivery mentioned in the preceding paragraph shall take place at the rental commencement date and time specified in Article 2, Paragraph 1, at the rental location specified in the same paragraph or a location approved by the Company.

If the rental fee is revised after a reservation has been made under Article 2, the lower of the fee applicable at the time of reservation and the fee applicable at the time of rental shall apply.
If the Renter intends to change the Rental Conditions set forth in Article 8, Paragraph 1 after the conclusion of the Rental Contract, the Renter shall obtain the prior consent of the Company.

The Renter or the Driver shall confirm that the inspections and maintenance set forth in the preceding two paragraphs have been executed, and that the Rented Car is free of maintenance defects and satisfies the Rental Conditions by inspecting the exterior of the vehicle body and accessories based on a separately prescribed inspection checklist.
If any maintenance defect is discovered in the Rented Car during the confirmation mentioned in the preceding paragraph, the Company shall immediately perform the necessary maintenance, etc.
Upon delivery of the Rented Car, the Company shall issue a prescribed rental certificate containing the matters stipulated by the Director of the Transport Branch Office of the Regional Bureau of Transport to the Renter or the Driver.

Upon receiving notice from the police regarding a parking violation involving the Rented Car, the Company shall contact the Renter or the Driver and instruct them to move or collect the vehicle promptly, and to report to the handling police station by the expiration of the rental period or by a time designated by the Company to resolve the violation. The Renter or the Driver shall comply with these instructions. Furthermore, if the Rented Car is towed by the police, the Company may, at its own discretion, retrieve the vehicle from the police.
After giving the instructions mentioned in the preceding paragraph, the Company may verify the status of the violation processing through traffic violation notices, payment forms, receipts, etc. If the violation remains unresolved, the Company shall repeat the instructions until it is settled. In addition, the Company shall request the Renter or the Driver to sign a document prescribed by the Company acknowledging the fact of the parking violation and agreeing to follow legal procedures as the violator (hereinafter referred to as the "Letter of Acknowledgment"), and the Renter or the Driver shall comply with this request.

The Company shall provide advice regarding the handling of the accident and cooperate toward its resolution for the benefit of the Renter or the Driver.

In the case of the preceding paragraph, the Renter or the Driver shall bear the expenses required for retrieving and repairing the Rented Car, and the Company shall not refund the received rental fee; provided, however, that this shall not apply if the Malfunctions, etc., are due to the reasons prescribed in Paragraph 3 or Paragraph 5.
If the Malfunctions, etc., arise from a defect that existed prior to the rental, a new Rental Contract shall be deemed concluded, and the Renter may receive an Alternative Rented Car from the Company. The conditions for providing an Alternative Rented Car shall apply mutatis mutandis to Article 5, Paragraph 2.
If the Renter chooses not to receive the Alternative Rented Car mentioned in the preceding paragraph, the Company shall refund the received rental fee in full. The same shall apply if the Company is unable to provide an Alternative Rented Car.
If the Malfunctions, etc., arise from causes not attributable to the Renter, the Driver, or the Company, the Company shall, similarly to the preceding paragraph, deduct the rental fee corresponding to the period from delivery to the termination of the Rental Contract from the received rental fee and refund the remaining balance to the Renter.
Except for the measures prescribed in this Article, the Renter and the Driver shall make no claims whatsoever against the Company for damages arising from the inability to use the Rented Car.
If the Renter or the Driver causes damage to a third party or the Company During Use of the Rented Car, they shall compensate for the damage; provided, however, that this shall not apply if the damage is due to reasons attributable to the Company.
Among the damages incurred by the Company mentioned in the preceding paragraph, damages arising from the Company's inability to use the Rented Car due to an accident, theft, a malfunction attributable to the Renter or Driver, or stains/odors in the vehicle shall be determined in accordance with the price list, etc., and the Renter or the Driver shall pay such amounts.
If the Renter or the Driver is held liable for compensation under Article 28, Paragraph 1, the damage insurance contract concluded by the Company for the Rented Car and the indemnification system prescribed by the Company shall cover the damages up to the following maximum limits:
(1) Bodily Injury Coverage: Unlimited per person (excluding the amount covered by Compulsory Automobile Liability Insurance)
(2) Property Damage Coverage: Unlimited per accident
(3) Vehicle Damage Coverage: Market value per accident

The insurance or indemnification system described in Paragraph 1 shall not apply if the situation falls under any disclaimer/exclusion clause of the insurance policy or indemnification system, or if the Renter or Driver rented the vehicle based on false declarations.
The insurance or indemnification system described in Paragraph 1 shall not apply if the Renter or Driver engaged in any of the prohibited acts listed in Article 17.

Damages caused intentionally or through gross negligence.
Damages arising from brawls (fighting acts), suicide attempts, or criminal acts.
The Renter or the Driver shall pay the injured third party or the Company for any damages to which the insurance or indemnification system does not apply, or for damages that exceed the insurance amount or indemnification coverage paid under Paragraph 1.
If the Company pays for damages that should be borne by the Renter or the Driver, the Renter or the Driver shall immediately reimburse the Company for the amount paid.
An amount equivalent to the insurance premium for the damage insurance contract prescribed in Paragraph 1 and the enrollment fee for the indemnification system prescribed by the Company are included in the basic rental fee.
If the Renter or the Driver violates these Terms and Conditions During Use, or falls under any of the items in Article 9, Paragraph 1, the Company may cancel the Rental Contract without any notice or demand and immediately demand the return of the Rented Car. In this case, the Company shall not refund the received rental fee to the Renter.
Even During Use, the Renter may cancel the Rental Contract with the consent of the Company, provided that the mid-term cancellation fee prescribed in the following paragraph is paid. In this case, the Company shall deduct the rental fee corresponding to the period from delivery to return from the received rental fee and refund the remaining balance to the Renter.
Upon cancellation as described in the preceding paragraph, the Renter shall pay the following mid-term cancellation fee to the Company:
Mid-Term Cancellation Fee = {(Basic fee corresponding to the total rental contract period) - (Basic fee corresponding to the period from delivery to return)} × 50%
