Company terms you should review before booking.
Article 1
Mirais Corporation (hereinafter referred to as "the Company") shall rent cars (hereinafter referred to as "rental cars") to borrowers (including drivers, hereinafter the same) in accordance with the provisions of this agreement, and the borrower shall rent the rental cars. Matters not stipulated in this agreement shall be governed by laws and general customs.
(Reservation)
Article 2
The borrower may reserve a rental car by specifying in advance the car model, start date and time, rental location, rental period, return location, driver, and other rental conditions, and the Company shall respond to reservations within the scope of available rental cars.
Reservations as per the preceding paragraph shall be made by paying a reservation deposit specified separately.
If the borrower does not commence the rental car rental agreement (hereinafter referred to as "rental agreement") within one hour of the reserved start time, the reservation shall be deemed canceled.
If the borrower cancels the reservation or changes the rental conditions specified in Paragraph 1, prior approval from the Company must be obtained.
(Conclusion of the Rental Agreement)
Article 3
The Company shall conclude the rental agreement upon the application of the borrower unless there are no available rental cars or the borrower falls under any of the items in Article 9. Furthermore, upon concluding the rental agreement, the Company may request the borrower to submit a driver's license and other identification documents, provide a contact phone number during the rental period, and may take copies of the submitted documents.
The application for the rental agreement shall be made by specifying the rental conditions defined in Paragraph 1 of the preceding article.
Upon concluding the rental agreement, the Company shall charge the rental fee as specified separately.
(Establishment of the Rental Agreement)
Article 4
The rental agreement shall be established when the Company receives the rental fee and hands over the rental car to the borrower. In this case, the reservation deposit shall be applied as part of the rental fee.
(Cancellation of the Rental Agreement)
Article 5
The Company may cancel the rental agreement without any notice or demand and immediately request the return of the rental car if the borrower falls under any of the following items during the rental period. In this case, the Company shall not refund the rental fee received under the preceding article. However, if there is a special agreement that the rental fee is payable later, or if there are unpaid amounts due to extension of the rental period, the borrower shall pay these fees.
(Termination of the Rental Agreement Due to Force Majeure)
Article 6
If the rental car becomes unusable during the rental period due to natural disasters or other force majeure events, the rental agreement shall be terminated.
(Midterm Cancellation)
Article 7
The borrower may cancel the rental agreement during the rental period with the Company's consent. In this case, the borrower shall pay the midterm cancellation fee specified in Article 25.
If the rental car is returned during the rental period due to an accident or breakdown attributable to the borrower, the rental agreement shall be deemed canceled.
When the borrower returns the rental car as per the preceding paragraph, the Company shall not refund the rental fee received under Article 4.
(Change of Rental Conditions)
Article 8
After the rental agreement has been established, if the borrower intends to change the rental conditions specified in Article 3, Paragraph 2, prior approval from the Company must be obtained.
(Refusal to Conclude the Rental Agreement)
Article 9
The Company may refuse to conclude the rental agreement if the borrower falls under any of the following items:
(Start Date and Time, etc.)
Article 10
The Company shall rent out the rental car specified in Article 1 at the start date and time and rental location specified in Article 3, Paragraph 2.
(Method of Rental, etc.)
Article 11
The Company shall conduct a daily inspection and maintenance as defined in Article 47-2 of the Road Transport Vehicle Law and an inspection of the vehicle's appearance and accessories based on a separate inspection checklist together with the borrower to confirm that there are no defects in the rental car before renting it out.
If any defects are found in the rental car during the inspection in the preceding paragraph, the Company shall take measures such as replacement.
Upon handing over the rental car, the Company shall provide the borrower with a rental car certificate as specified by the Director of the District Transport Bureau.
The borrower shall be responsible for properly installing the child seat, and the borrower shall bear all responsibility.
(Rental Fees)
Article 12
The rental fees received by the Company under Article 4 shall be in accordance with the fee schedule reported to and implemented by the District Transport Bureau at the time of rental.
(Handling of Rental Fee Revisions)
Article 13
If the rental fee is revised after the reservation under Article 2, the fee schedule applied at the time of reservation shall prevail.
(Regular Maintenance)
Article 14
The Company shall rent out a rental car that has undergone regular maintenance as defined in Article 48 of the Road Transport Vehicle Law.
(Daily Maintenance)
Article 15
The borrower shall perform daily maintenance as defined in Article 47-2 of the Road Transport Vehicle Law on the rental car before using it each day during the rental period.
(Management Responsibility of the Borrower)
Article 16
The borrower shall use and manage the rental car with the duty of care of a good manager.
(Prohibited Acts)
Article 17
The borrower shall not engage in the following acts during the rental period of the rental car:
(Obligation to Carry Rental Car Certificate, etc.)
Article 18
The borrower shall carry the rental car certificate received under Article 11, Paragraph 3, during the rental period.
(Compensation Responsibility)
Article 19
The borrower shall compensate any damage caused to third parties or the Company while using the rental car, except in cases where the damage is not attributable to the borrower.
(Accident Handling)
Article 20
In the event of an accident involving the rental car during the rental period, the borrower shall take legal measures regardless of the accident's size and handle the situation as follows:
Immediately report the accident details to the Company.
Promptly submit any documents or evidence required by the Company and its insurance company regarding the accident.
Obtain prior approval from the Company before settling or negotiating with third parties regarding the accident.
Repair the rental car at the Company or a repair shop designated by the Company unless there are special reasons.
The borrower shall also strive to resolve the accident at their responsibility in addition to the measures in the preceding paragraph.
The Company shall advise and cooperate in resolving the accident involving the rental car for the borrower's benefit.
(Compensation)
Article 21
The Company shall cover the borrower's liability for damages under Article 19, Paragraph 2, within the following limits through the insurance contract concluded for the rental car and the Company's compensation system:
Unlimited coverage per person for personal compensation (including compulsory automobile liability insurance).
Unlimited coverage per accident for property damage compensation: no deductible.
Actual cash value per accident for vehicle compensation: deductible of 50,000 yen.
Damages exceeding the compensation limits specified in the preceding paragraph shall be the borrower's responsibility.
If the Company pays damages exceeding the compensation limits in Paragraph 1, the borrower shall immediately reimburse the excess amount to the Company.
The compensation system does not apply to damages resulting from accidents not reported to the police and the Company, accidents falling under the exclusions in the insurance terms, accidents occurring after the rental without approval as specified in Article 9, Items 1 to 8 or Article 17, Items 1 to 6, and damages occurring after extending the rental period without the Company's approval.
(Handling Failures, etc.)
Article 22
If the borrower discovers any abnormality or failure of the rental car during the rental period, they shall immediately stop driving and contact the Company, following its instructions.
If the abnormality or failure of the rental car is due to the borrower's intentional or negligent act, the borrower shall bear the costs of retrieving and repairing the rental car.
If the rental car becomes unusable due to a defect existing before the rental, the borrower may receive a replacement rental car or similar measures from the Company.
Except for the measures specified in the preceding paragraph, the borrower shall not claim any damages from the Company for being unable to use the rental car.
(Exemption Due to Force Majeure)
Article 23
The Company shall not hold the borrower responsible for any damages arising if the borrower cannot return the rental car within the rental period due to natural disasters or other force majeure events. In such cases, the borrower shall immediately contact the Company and follow its instructions.
(Reservation Cancellation, etc.)
Article 24
If the borrower cancels the reservation made under Article 2 or fails to conclude the rental agreement within one hour of the scheduled rental time for reasons attributable to the borrower, the borrower shall pay a reservation cancellation fee as specified separately. If the reservation deposit has been received by the Company, the reservation cancellation fee shall be offset against it.
If the Company cancels the reservation received under Article 2 or fails to conclude the rental agreement due to the Company's reasons, the reservation deposit shall be refunded.
If the rental agreement is not concluded due to reasons other than those specified in the preceding two paragraphs, the reservation shall be deemed canceled. In this case, the Company shall refund the reservation deposit after deducting the reservation cancellation fee.
The Company and the borrower shall not make any claims against each other regarding the failure to conclude the rental agreement, except as specified in the preceding three paragraphs.
(Midterm Cancellation Fee)
Article 25
If the borrower cancels the rental agreement midterm as specified in Article 7, Paragraph 1, the borrower shall pay a midterm cancellation fee in addition to the rental fees corresponding to the period until the cancellation. Midterm cancellation fee = (Rental fee for the rental agreement period - Rental fee for the period from rental to cancellation) × 50%
(Refund of Rental Fees)
Article 26
The Company shall refund all or part of the rental fees received from the borrower under the following conditions:
(Confirmation of the Rental Car, etc.)
Article 27
The borrower shall return the rental car to the Company in the same condition as when received, except for normal wear and tear from use.
The Company shall confirm the condition of the rental car upon return in the presence of the borrower.
The borrower shall confirm in the presence of the Company that there are no personal belongings of the borrower or co-passengers left in the rental car upon return. The Company shall not be responsible for any items left behind after the return.
(Return Period of the Rental Car, etc.)
Article 28
The borrower shall return the rental car within the rental period.
If the borrower extends the rental period under Article 8, Paragraph 1, they shall pay either the rental fee corresponding to the changed rental period or the rental fee before the change plus the excess fee, whichever is lower.
If the borrower returns the rental car after the rental period without the Company's approval as specified in Article 8, Paragraph 1, the borrower shall pay a special extension fee calculated as follows: Special extension fee = Excess hours × Excess fee rate × 300%
(Return Location, etc.)
Article 29
If the borrower or driver changes the specified return location under Article 3, Paragraph 2, they shall bear the costs necessary for returning the rental car to the new location.
(Payment for Insufficient Fuel)
Article 30
If the rental car is not returned with a full tank of fuel, the borrower shall pay for the fuel based on the rates separately specified by the Company.
(Handling When the Rental Car is Not Returned)
Article 31
If the borrower does not return the rental car to the specified return location in Article 29, Paragraph 1, within 72 hours after the rental period ends and does not respond to the Company's return request or if the borrower's whereabouts are unknown, the Company shall take necessary legal action.
(Consumption Tax)
Article 32
The borrower shall pay the consumption tax imposed on monetary obligations under this agreement to the Company separately.
(Late Payment Penalty)
Article 33
If the borrower fails to fulfill monetary obligations under this agreement, they shall pay the Company a late payment penalty at an annual rate of 14.6%.
(Use of Personal Information)
Article 34
The borrower or driver consents to the use of personal information by the Company for the purpose of verifying and reviewing customer identity.
(Detailed Rules of the Agreement)
Article 35
The Company may separately establish detailed rules for implementing this agreement.
(Jurisdiction Court)
Article 36
If a dispute arises regarding rights and obligations under this agreement, the court with jurisdiction over the location of the Company's head office shall have jurisdiction.
Supplementary Provisions: This agreement shall come into effect on April 30, 2024.
The fees below apply depending on when you cancel.
Cancellation policy:
7 days prior to the reserved date: Free
6 to 3 days prior to the reserved date: 20%
2 days to the day before the reserved date: 30%
On the reserved date: 100%
If you cancel the reservation, the cancellation fees mentioned above will be applied.
Please note that the cancellation request will be processed based on business hours (until 5:00 PM).
