Terms of use

Company terms you should review before booking.

Chapter 1 General Provisions

Article 1 (Application of these Terms and Conditions)

  1. The Company shall rent out a rental car (hereinafter, “Rental Car”) to the party receiving the rental (hereinafter, the “Renter”) in accordance with these Terms and Conditions and the detailed regulations based on Article 40 of these Terms and Conditions (collectively referred to as “Terms, etc.”). The Renter shall fully understand and agree to the Terms, etc. before renting the Rental Car.
  2. In the event the Renter designates another person as the driver in accordance with Article 8, Paragraph 3, the Renter must ensure that the designated driver fully understands and complies with the portions of the Terms, etc. relevant to the driver. Any matters not stipulated in the Terms, etc. shall be governed by applicable laws or general customary practices.
  3. The Company may enter into special agreements with the Renter to the extent that such agreements do not conflict with the intent of the Terms, etc., relevant laws, administrative guidelines, or general customary practices. In the event a special agreement is made, such special agreement shall take precedence over the Terms, etc.

Chapter 2 Reservations

Article 2 (Application for Reservations)

  1. If the Renter wishes to rent a Rental Car, they may apply in advance by specifying the vehicle class, start date and time of the rental, location of rental, rental period, return location, driver, whether child seats or other accessories are required, and other conditions of rental (hereinafter, “Rental Conditions”) in accordance with the methods separately prescribed by the Company. The Renter must agree to these Terms and Conditions, as well as the fee schedule and other rules separately established by the Company, before making the reservation application.
  2. When the Company receives a reservation application from the Renter, in principle the Company will accept the reservation within the scope of the Rental Cars it owns and the Rental Conditions that the Company approves.
  3. Except where the Company specifically agrees otherwise, the Renter shall pay a separately prescribed reservation fee when making the reservation application.

Article 3 (Changes to Reservations)
If the Renter wishes to change any of the Rental Conditions stipulated in Paragraph 1 of Article 2, the Renter must obtain the Company’s prior approval.

Article 4 (Cancellation of Reservations, etc.)

  1. The Renter and the Company shall execute the rental agreement for the Rental Car (hereinafter, the “Rental Agreement”) by the start date and time of the rental specified in Paragraph 1 of Article 2.
  2. The Renter and the Company may cancel the reservation in accordance with the methods prescribed by the Company. In addition, if more than one hour has elapsed from the reserved start time of the rental and the Rental Agreement (hereinafter also referred to as the “Rental Agreement”) has not been executed for any reason, the reservation shall be deemed canceled regardless of the cause.
  3. If the reservation is canceled due to reasons attributable to the Renter, the Renter shall pay a cancellation fee to the Company in accordance with rules separately prescribed. After receiving such cancellation fee, the Company shall refund to the Renter any reservation fee previously received.
  4. Even if the Renter has not paid the cancellation fee, the Company may offset an amount equivalent to the cancellation fee against the reservation fee already received. After such offset, any balance remaining shall be returned to the Renter, and the Renter hereby consents to this arrangement.
  5. If the reservation is canceled due to reasons attributable to the Company, the Company shall refund the reservation fee already received and pay a penalty fee in accordance with rules separately prescribed.
  6. In the event the Rental Agreement cannot be executed due to accident, theft, non-return, recall, natural disaster, or other reasons not attributable to either the Renter or the Company, the reservation shall be deemed canceled. In such cases, the Company shall refund the reservation fee already received to the Renter.

Article 5 (Alternative Rental Car)

  1. If the Company is unable to provide a Rental Car of the vehicle class the Renter reserved, it may propose to provide a vehicle in a different class (hereinafter, an “Alternative Rental Car”).
  2. If the Renter accepts the proposal in the preceding paragraph, the Company shall rent out the Alternative Rental Car under the same Rental Conditions as those at the time of reservation, except for the vehicle class. However, if the rental fee for the Alternative Rental Car is higher than that of the originally reserved vehicle class, the fee for the reserved vehicle class shall apply; if the rental fee is lower, the rental fee for the Alternative Rental Car’s class shall apply.
  3. The Renter may refuse the proposal of an Alternative Rental Car under Paragraph 1 and cancel the reservation.
  4. In the case of the preceding paragraph, if the reason that the Company cannot provide the vehicle as reserved under Paragraph 1 is attributable to the Company, Paragraph 4 of Article 4 (cancellation of reservation due to the Company’s reasons) shall apply, and the Company shall refund the reservation fee already received and pay a penalty fee in accordance with rules separately prescribed.
  5. In the case of Paragraph 3, if the reason that the Company cannot provide the vehicle as reserved under Paragraph 1 is not attributable to the Company, Paragraph 5 of Article 4 (cancellation of reservation for reasons not attributable to either party) shall apply, and the Company shall refund the reservation fee already received to the Renter.

Article 6 (Exemption of Liability)
Except as otherwise provided in Articles 4 and 5, the Company and the Renter shall not make any mutual claims of any kind arising from the cancellation of the reservation or the failure to execute the Rental Agreement.

Article 7 (Reservation Services by Third Parties)

  1. The Renter may apply for reservations through a travel agency or business partner (hereinafter, a “Representative”) that handles reservations on behalf of the Company.
  2. If the Renter has made the reservation application through such a Representative, any requests for changes or cancellations of the reservation must also be made through that same Representative.

Chapter 3 Rental

Article 8 (Execution of the Rental Agreement)

  1. The Renter shall specify the rental conditions set forth in Article 2, Paragraph 1, and the Company shall specify the rental conditions through these Terms and Conditions, the fee schedule, etc., to conclude a rental agreement. However, this does not apply if no Rental Car is available or if the Renter or the driver falls under any of the items in Article 9, Paragraphs 1 or 2.
  2. When the rental agreement is concluded, the Renter shall pay the rental fees set forth in Article 11, Paragraph 1, to the Company.

Therefore, at the time the rental agreement is concluded, the Company may require the Renter to present the driver’s license of the person designated by the Renter (hereinafter, the “Driver”) and may also require a copy of said license. If the Renter is the driver, the Renter must present or submit a copy of their own driver’s license; if the Renter and driver are different individuals, the driver’s license of that other person must be presented or submitted.

Footnote 1: “Fundamental directives of the supervisory authority” refers to the Director of the Automobile Bureau, Ministry of Land, Infrastructure, Transport, and Tourism’s notification “Basic Official Notice Concerning Car Rental” (Jayo No. 138, June 13, 1995), Sections 2.(10) and (11).
Footnote 2: “Driver’s license” refers to the driver’s license stipulated in Article 92 of the Road Traffic Act, specifically the license in Form No. 14 of the Appendix to Article 19 of the Enforcement Regulations of the Road Traffic Act. International driving permits and foreign driver’s licenses under Article 107-2 of the Road Traffic Act are treated as equivalent to a driver’s license.

  1. At the time of concluding the rental agreement, the Company may require the Renter and the Driver to present supplemental documents designated by the Company, in addition to the driver’s license, and may keep copies of such documents.
  2. At the time of concluding the rental agreement, the Company may require the Renter to provide contact information (such as a mobile phone number) that can be used to reach the Renter or the Driver during the rental period.
  3. At the time of concluding the rental agreement, the Company may require payment by credit card or cash, or designate another payment method for the Renter.
  4. If the Renter or the Driver fails to comply with the preceding six paragraphs, the Company may refuse to conclude the rental agreement and may cancel the reservation. In such cases, the deposit or any other fees already paid shall be handled in accordance with Article 4, Paragraph 5.

Article 9 (Refusal to Execute a Rental Agreement)

  1. If the Renter or the Driver falls under any of the following items, the Company shall refuse to conclude the rental agreement and shall simultaneously cancel the reservation:

    2. Is deemed to be under the influence of alcohol.

    4. Intends to have a child under 6 years old on board without a child seat (infant/child seat) when one is not available.
    5. Is recognized as a member, affiliate, or related party of an organized crime group, or any other antisocial force.
    6. Has committed an act that violates these Terms and Conditions or the detailed regulations.
  2. Even if none of the items in the preceding paragraph apply, if the Renter or the Driver falls under any of the following items, the Company shall refuse to conclude the rental agreement and shall simultaneously cancel the reservation:
    1. The driver at the time of concluding the rental agreement differs from the driver specified at the time of reservation.
    2. The Renter has a record of unpaid rental fees or other unpaid debts owed to the Company from previous rentals.
    3. The Renter has committed any act corresponding to Article 17 during a previous rental.
    4. In a previous rental (including rentals from other car rental businesses), the Renter committed any act corresponding to Article 18, Paragraph 6 or Article 25, Paragraph 1.
    5. In a previous rental, due to a violation of the rental agreement or insurance policy terms, automobile insurance coverage was denied.
    6. In relation to transactions with the Company, the Renter or the Driver engaged in violent acts or speech against the Company’s employees or other related persons, or demanded something beyond a reasonable scope.
    7. The Renter or the Driver spread rumors or used fraudulent or coercive means to damage the Company’s credit or hinder its business.
    8. The Renter otherwise fails to meet conditions specified separately by the Company.
    9. Any other circumstances in which the Company deems it inappropriate to execute the rental agreement.
  3. In the cases of the preceding two paragraphs, if a reservation had already been established, that reservation shall be deemed canceled. If the Renter has paid a reservation cancellation fee, the Company shall refund any reservation deposit already received.

Article 10 (Formation of the Rental Agreement, etc.)

  1. The rental agreement is formed at the time the Renter pays the rental fees to the Company and the Company hands over (delivers) the Rental Car to the Renter. At this time, any reservation fee already received shall be applied toward the rental fees.
  2. The handover mentioned in the preceding paragraph occurs at the rental start time and location specified in Article 2, Paragraph 1.

Article 11 (Rental Fees)

  1. “Rental Fees” refers to the total of the following charges, and the Company shall specify either the amount or the calculation basis for each charge in its fee schedule:
    1. Basic Charge
    2. Collision Damage Waiver (CDW) or Liability Waiver Fee
    3. Special Equipment Fee
    4. One-way Fee
    5. Fuel Charge
    6. Vehicle Pickup/Delivery Fee
    7. Other Fees
  2. The basic charge shall be the fee that the Company has reported to and put into effect with the local transportation bureau’s director (or the head of the relevant local office in each jurisdiction; the same applies to Article 14, Paragraph 1) at the time of the rental.
  3. If the rental fee schedule is revised after a reservation is made under Article 2, the lesser of (a) the rate in effect at the time of reservation or (b) the rate in effect at the time of rental shall apply.

Article 12 (Changes to Rental Conditions)

  1. If the Renter wishes to change the rental conditions specified in Article 8, Paragraph 1 after the rental agreement is concluded, the Renter must obtain the prior approval of the Company.
  2. The Company may refuse to approve such changes if it determines that altering the rental conditions would interfere with its rental operations.

Article 13 (Inspections and Maintenance)

  1. The Company shall perform inspections as stipulated in Article 48 of the Road Transport Vehicle Act (Periodic Inspection and Maintenance) and rent out a Rental Car that has undergone any necessary maintenance.
  2. The Company shall perform inspections as stipulated in Article 47-2 of the Road Transport Vehicle Act (Daily Inspection and Maintenance) and carry out any necessary maintenance.
  3. The Renter or Driver shall confirm that the inspections and maintenance required under the preceding two paragraphs have been performed and, based on the separately designated inspection checklist, verify that there are no maintenance deficiencies and that the Rental Car otherwise meets the Rental Conditions.

Article 14 (Issuance and Possession of Rental Certificate)

  1. At the time the Rental Car is delivered, the Company shall provide the Renter with a prescribed rental certificate (in writing or via electronic means such as email), bearing the matters set forth by the local transportation bureau director.
  2. While using the Rental Car, the Renter or Driver must keep the rental certificate on hand (including in an electronic format).
  3. If the Renter or Driver loses the rental certificate, they must immediately notify the Company.

Chapter 4 Use

Article 15 (Management Responsibility, etc.)

  1. From the time the Rental Car is received until it is returned to the Company (hereinafter, “during use”), the Renter or Driver shall use and store the Rental Car with the duty of care of a prudent manager.
  2. Furthermore, when using the Rental Car, the Renter or Driver shall comply with applicable laws, these Terms, the detailed regulations, the vehicle’s instruction manual, and any other usage methods indicated by the Company.
  3. If, during use, the Renter or Driver uses any toll road (including expressways), pay parking facilities, or other paid services, the Renter or Driver shall be responsible for paying such fees directly to the service provider.
  4. If the Company is requested by the service provider to disclose personal information of the Renter due to unpaid fees or similar issues in connection with the Rental Car, and the request includes details such as the car’s license plate number, date, and location of use, then the Renter agrees that the Company may provide the requested personal information of the Renter.

  1. If the Renter or Driver illegally parks the Rental Car in violation of the Road Traffic Act during use, the Renter or Driver shall immediately appear at the relevant police station, pay any fines, and bear all related costs for towing, storage, and retrieval of the Rental Car.
  2. Upon receiving notification from the police about the Rental Car’s violation of parking regulations, the Company shall contact the Renter or Driver, instruct them to move or retrieve the Rental Car promptly, and require them—by the end of the rental period or at a time designated by the Company—to appear at the relevant police station to resolve the violation. The Renter or Driver must comply with these instructions. If the Rental Car has been moved by the police, the Company may, if deemed necessary, retrieve the Rental Car directly from the police.

After issuing the instruction in the preceding paragraph, the Company shall verify, at its own discretion, whether the violation has been resolved by reviewing documentation such as the notice of traffic fines or proof of payment. If the violation has not been resolved, the Company shall repeatedly instruct the Renter or Driver to comply. The Company may also require the Renter or Driver to sign a document (hereinafter, the “Acknowledgment”) stating that they acknowledge and accept responsibility for the parking violation and that they will submit to legal measures by the police, and the Renter or Driver shall cooperate.
  4. If deemed necessary, the Company may submit the Acknowledgment, rental certificate, or other records containing personal information to the police and otherwise provide assistance for holding the Renter or Driver accountable for the parking violation. The Company may also take the necessary legal measures to report the violation, including submitting an explanation and the Acknowledgment, rental certificate, etc., to the public safety commission with jurisdiction (pursuant to Road Traffic Act Article 51-4, Paragraph 6). The Renter or Driver consents to such disclosures.
  5. If the Company receives an order to pay the “penalty for leaving the vehicle unattended” (hereinafter, “Leaving-Vehicle Violation Penalty”) under Road Traffic Act Article 51-4, Paragraph 1, and the Company pays it on behalf of the Renter or Driver, or if the Company bears any costs to locate the Renter or Driver, move, store, or retrieve the Rental Car, the Company may charge the Renter for the following amounts (hereinafter, “Parking Violation-Related Costs”). The Renter shall pay these amounts by the deadline set by the Company:
    1. The Leaving-Vehicle Violation Penalty amount
    2. A separately prescribed breach-of-contract charge for illegal parking
    3. The cost of locating, moving, storing, and retrieving the Rental Car
  6. If the Company has received an order to pay the Leaving-Vehicle Violation Penalty as described in the preceding paragraph, or if the Renter fails to pay the full amount claimed in the preceding paragraph by the prescribed deadline, the Company may register the Renter’s name, date of birth, driver’s license number, and other relevant information in the information management system of the All Japan Rent-A-Car Association (hereinafter, “AJRA System”), or take similar measures. The Renter consents to this.
  7. If, in the situation described in Paragraph 1, the Renter or Driver fails to comply with the instructions in Paragraph 2 or refuses to sign the Acknowledgment mentioned in Paragraph 3, the Company may collect a separately prescribed deposit (hereinafter, the “Illegal Parking Deposit”) from the Renter for the purpose of covering the Leaving-Vehicle Violation Penalty and the breach-of-contract charge described in Paragraph 5.
  8. Notwithstanding Paragraph 6, if the Company has received from the Renter the full amount of the Illegal Parking Deposit as well as the costs set forth in Paragraph 5(3), the Company will not register the data in the AJRA System described in Paragraph 6, or if the data has already been registered, it will be removed.
  9. After the Renter has already paid the amount claimed by the Company under Paragraph 5, if the Renter or Driver later pays the relevant traffic fine or is prosecuted such that the order to pay the Leaving-Vehicle Violation Penalty is rescinded and the Company receives a refund of the penalty amount, the Company shall refund to the Renter any portion of the Parking Violation-Related Costs corresponding to the Leaving-Vehicle Violation Penalty it had received. The same applies if the Company has collected the Illegal Parking Deposit under Paragraph 7.
  10. If the data was registered in the AJRA System in accordance with Paragraph 6 but the Leaving-Vehicle Violation Penalty order is subsequently canceled by payment of the fine or otherwise, or if the Renter settles the full amount claimed by the Company under Paragraph 5, the Company shall remove the relevant information from the AJRA System.

Article 19 (GPS Function)

  1. The Renter and the Driver acknowledge that the Rental Car may be equipped with a Global Positioning System (“GPS Function”) and that the Company’s system may record the current location and driving route of the Rental Car. The Renter and the Driver agree that the Company may use such recorded information for the following purposes:
    1. To verify whether the Rental Car has been returned to the designated location at the end of the rental period.
    2. If necessary (e.g., in cases falling under Article 25, Paragraph 1) for Rental Car management or the performance of the rental agreement, to confirm the Rental Car’s current location.
    3. To improve the quality and customer satisfaction of products and services provided to the Renter and Driver, by processing the information in a form that does not identify or specify individuals and using it for marketing analysis.

    1. To verify the situation at the time of any accident.
    2. To confirm the Renter’s or Driver’s driving behavior if deemed necessary for managing the Rental Car or performing the rental agreement.
    3. To improve the quality and customer satisfaction of products and services provided to the Renter and Driver, by processing the information in a form that does not identify or specify individuals and using it for marketing analysis.
  2. The Renter and the Driver agree that if the Company is requested or ordered by law, a court, an administrative authority, or another public institution to disclose the recorded information mentioned above, the Company may disclose the information to the extent necessary.

Chapter 5 Return

Article 21 (Obligation to Return)

  1. The Renter or Driver shall return the Rental Car to the Company by the end of the rental period, at the designated return location.
  2. If the Renter or Driver violates the preceding paragraph, the Renter shall compensate the Company for any damages incurred.
  3. If the Renter or Driver is unable to return the Rental Car within the rental period due to force majeure such as a natural disaster, they shall immediately contact the Company and follow the Company’s instructions.

Article 22 (Verification upon Return, etc.)

  1. The Renter or Driver shall return the Rental Car in the presence of the Company’s representative. At this time, except for normal wear and tear or deterioration due to ordinary use, and damage not caused by the Renter’s or Driver’s fault, the car must be returned in the same condition as when it was delivered.
  2. The Renter or Driver shall check the interior of the Rental Car for any items they or any passenger may have left behind before returning it.

Article 23 (Rental Fees for Changes to the Rental Period)

  1. If the Renter changes the rental period in accordance with Article 12, Paragraph 1, the Renter shall pay the rental fees corresponding to the extended period.

Article 24 (Return Location, etc.)

  1. If the Renter changes the return location in accordance with Article 12, Paragraph 1, the Renter shall bear any costs arising from the need to relocate the vehicle.
  2. If the Renter returns the Rental Car to a location other than the designated return location without the Company’s prior approval under Article 12, Paragraph 1, the Renter shall bear the costs in accordance with Paragraph 3 of Article 25.

Article 25 (Measures Taken When the Vehicle Is Not Returned)

  1. If, after the rental period has expired, the Renter or Driver does not return the Rental Car to the designated return location, and does not respond to the Company’s request to return the vehicle (or if the whereabouts of the Renter become unknown, etc.), thereby creating a non-return situation, the Company may file criminal charges or take other legal measures. The Company may also report the non-return incident to the All Japan Rent-A-Car Association and register the incident in the AJRA System or take similar actions, and the Renter consents to this.
  2. In the event described in the preceding paragraph, the Company may take necessary steps to locate the Rental Car, including inquiring with the Renter’s or Driver’s family, relatives, workplace, and other related parties, and utilizing the GPS function.
  3. In the event described in Paragraph 1, the Renter shall be liable for damages incurred by the Company and shall also bear any costs associated with recovering the Rental Car and locating the Renter or Driver.

Chapter 6: Procedures for Breakdowns, Accidents, and Theft

Article 26 (Procedure Upon Discovering a Breakdown)
If, during use, the Renter or Driver discovers any abnormality or malfunction in the Rental Car, they shall immediately discontinue driving, contact the Company, and follow the Company’s instructions.

Article 27 (Procedure in the Event of an Accident)

  1. If any accident involving the Rental Car occurs during use—regardless of the scale of the accident—the Renter or Driver shall immediately discontinue driving, take all legally required measures, and also perform the following steps:
    1. Immediately report the accident details to the Company and follow the Company’s instructions.
    2. If the Rental Car is to be repaired in accordance with the instructions mentioned in the preceding item, it shall be repaired by the Company or at a repair shop designated by the Company, unless otherwise approved by the Company.
    3. Cooperate with the investigation of the Company and the insurance company with which the Company has contracted, and promptly submit any documents they require.
    4. If the Renter or Driver conducts settlement negotiations with the other party involved in the accident (including out-of-court settlements), they must first obtain the Company’s approval.
  2. In addition to performing the steps stated in the preceding paragraph, the Renter or Driver shall handle and resolve the accident on their own responsibility.
  3. The Company shall provide advice regarding the accident and cooperate in resolving it on behalf of the Renter or Driver.
  4. When an accident or other incident occurs, if the Rental Car is equipped with a drive recorder (dashcam), the device shall record any impact, sudden braking, or other pertinent events to confirm the circumstances at that time.
  5. If deemed necessary, the Company may take actions such as reviewing or verifying the records mentioned in the preceding paragraph.

Article 28 (Procedure in the Event of Theft)
If the Rental Car is stolen or otherwise damaged during use, the Renter or Driver shall perform the following steps:

  1. Immediately file a report with the nearest police station.
  2. Immediately notify the Company of the damage (e.g., theft) and follow the Company’s instructions.
  3. Cooperate with the investigation of the Company and the insurance company with which the Company has contracted, and promptly submit any documents they require regarding the theft or any other damage.

Article 29 (Termination of Rental Agreement Due to Inability to Use Vehicle)

  1. In the event that the Rental Car becomes unusable during use due to a breakdown, accident, theft, or other reason (hereinafter, “Breakdown, etc.”), the rental agreement shall be deemed terminated.
  2. In such cases, the Renter shall bear any costs incurred for retrieving or repairing the Rental Car, and the Company shall not refund any rental fees already received. However, exceptions may apply if the Breakdown, etc. falls under Paragraph 3 or Paragraph 5 of this Article.
  3. If the Breakdown, etc. arises from a defect or malfunction existing prior to the rental, or if the Rental Car did not meet the Rental Conditions, the situation is deemed to constitute a new rental agreement. The Renter may receive a replacement Rental Car from the Company, under conditions governed by Article 5, Paragraph 2.
  4. If the Renter elects not to receive the replacement Rental Car described in the preceding paragraph or if the Company is unable to provide a replacement Rental Car, the Company shall refund all rental fees already received.
  5. If the Breakdown, etc. occurs for reasons not attributable to either the Renter/Driver or the Company, the Company shall refund the Renter the portion of the rental fees remaining after deducting the fees corresponding to the period from the start of the rental through the termination of the rental agreement.
  6. The Renter may not claim from the Company any damages arising from the inability to use the Rental Car, except where the Breakdown, etc. is due to the Company’s willful misconduct or gross negligence.

Chapter 7: Compensation and Insurance

Article 30 (Damages and Business Compensation)

  1. In connection with use of the Rental Car, if the Renter or Driver causes damage to the Company’s Rental Car, the Renter shall compensate the Company for such damage. However, this does not apply if there is no fault on the part of the Renter or Driver.
  2. If the Renter becomes liable for damages under the preceding paragraph, the Renter shall compensate or pay business compensation to the Company—according to the provisions of the fee schedule—for damage suffered by the Company due to the Rental Car being unusable because of an accident, theft, breakdown, or contamination/odor, etc.
  3. In the event that the Renter or Driver causes damage to a third party or to the Company, through willful misconduct or negligence in connection with use of the Rental Car, the Renter or Driver shall be liable for compensating such damage.

Article 31 (Insurance and Compensation)

  1. If the Renter (who has liability for damages as specified in Paragraph 1 or Paragraph 3 of the preceding Article) or the Driver (who has liability for damages as specified in Paragraph 3 of the preceding Article) is liable for damages, insurance payments shall be paid under the damage insurance contract that the Company has taken out for the Rental Car, up to the following limits:
    • Bodily Injury: Unlimited per person (including compulsory automobile liability insurance)
    • Property Damage: Unlimited per accident (deductible of JPY 200,000)
    • Vehicle Damage: Actual cash value (ACV) per accident (deductible of JPY 200,000)
    • Personal Injury Compensation: Up to JPY 50,000,000 per person
  2. If the accident falls under an exclusion specified in the relevant insurance policy, no insurance payment will be made under Paragraph 1.
  3. If the Rental Agreement is violated, no insurance or compensation payment as provided in Paragraph 1 will be made.
  4. The Renter or Driver shall be liable for any losses not covered by the insurance or compensation, as well as any amount exceeding the policy limits in Paragraph 1. If the policy limit is changed by a special agreement, the Renter or Driver shall be liable for damages exceeding that revised limit. However, if the damage arises from a disaster designated as a “serious disaster” under Article 2 of the Act on Special Financial Aid to Deal with Extremely Severe Disasters (Act No. 150 of 1962) (hereinafter, “Extremely Severe Disaster”), and the damage occurred within an area so designated, and there was no willful misconduct or gross negligence by the Renter or Driver in causing such damage, the Renter or Driver shall not be required to compensate for that damage.
  5. If the Company pays any amount on behalf of the Renter or Driver for damages for which the Renter or Driver is liable, the Renter or Driver shall immediately reimburse the Company in full.
  6. Except as otherwise provided in a special agreement, the Renter or Driver shall bear the deductible amounts under Paragraph 1(2) and Paragraph 1(3).

Chapter 8: Termination of the Rental Agreement

Article 32 (Termination of the Rental Agreement)

  1. If the Renter or Driver violates these Terms and Conditions during use, or if the Renter or Driver falls under any of the items in Article 9, Paragraph 1, the Company may, without notice or demand, terminate the Rental Agreement and immediately demand the return of the Rental Car. In such cases, the Company shall deduct the portion of the rental fees corresponding to the period from the start of the rental to the time of termination and refund the balance to the Renter.
  2. If any of the circumstances described in the preceding paragraph occur, the Renter shall compensate the Company for any damages incurred by the Company.

Article 33 (Cancellation of the Rental Agreement During the Rental Period)

  1. The Renter may, even during the rental period, cancel the Rental Agreement with the Company’s consent by paying the mid-term cancellation fee set forth below. Unless otherwise specified, the Company shall refund to the Renter any remaining balance of the rental fees after deducting the portion corresponding to the period from the start of the rental to the time of return.
  2. If the Renter cancels under the preceding paragraph, the Renter shall pay the Company the following mid-term cancellation fee:

Mid-term Cancellation Fee

    5. To compile and analyze personal information statistically and create statistical data processed in a form that does not identify or specify individuals.
